These terms (as well as all documents referred to herein) specify the Terms and Conditions (the “Terms”) which will apply when an order (‘Order’) is placed from the products (the “Products”) referred to on the Lebami (‘Lebami’, ‘Our’, ‘us’, ‘we’) website . Please read these terms carefully before ordering any of our Products.

If you do not agree to these Terms, then you may not use the Platforms.
Lebami reserves the right to modify these Terms from time to time, at its sole discretion, without prior notice. You agree that each visit you make to the Platforms shall be subject to the then-current Terms and Conditions and Privacy Policy if applicable and continued use of the Platforms following modifications of these Terms confirms that you have read, accepted, and agreed to be bound by such modifications.
If you do not accept the notified changes you may continue to use the Platforms and the Service in accordance with the existing terms, but certain new features may not be available to you.
In the event you are a consumer, your legal rights will apply in addition to these Terms but will not replace them, unless there is a contradiction and the consumer rights are mandatory, then the consumer rights will prevail and apply.
In all the countries in which we operate, and in addition to consumer rights, all laws and regulations relating to e-commerce and electronic transactions, as well as any specific laws to our industry, issued by any governmental authority, shall together with these Terms be applicable, unless a contradiction arises between these Terms and any mandatory law or regulation amongst the aforementioned laws and regulations. In such case, the mandatory law or regulation will prevail and apply.
By setting up a Lebami Account, you confirm your acknowledgement and acceptance of these Terms.
You must be 18 or over to accept these terms and use the platforms or its related services.
These terms also apply to all merchanting channels of the company and its affiliates including, but not limited to, the internet, telephone, catalog, radio, television, mobile device, social media and participating retail stores. By accessing any of the company merchandising channels, and any areas of the service, you agree to be legally bound, and to abide, by these terms. Please be aware that these terms contain a class action waiver that waive your right to a court hearing.
Your Account
In order for you to use the Lebami Platforms, you have to agree to live by the terms stated below. By using this system to create an account or order a product, you also consent to be bound by Lebami’s terms. You are in charge of setting up any requirements so that you can use the Platforms. It shall also be your responsibility to see that everyone who uses the Platforms is aware of these Terms and abides by them. Without restriction or qualification, you accept these Terms as a legally binding agreement between you and Lebami by reading, using, accessing, browsing, or contributing any content or material on the Platforms. “You” or “Your” refers to you and/or any individual or organization who accesses, browses, views, uses, or contributes any content or material to the Platform; it also refers to you and/or any individual that uses the Platforms to place a real order using your account. As a result, it is acknowledged and understood that you are in charge of keeping your account’s credentials secure, including the password, and that you are also in charge of paying for any orders that you place using your account.
Your Order
Once you have selected your Order from our Products you will be given the opportunity to submit your Order by clicking on “Checkout” button.
Please note it is important that you verify the accuracy of the information that you enter and correct any errors before clicking on the “Checkout” button since once you click on this input errors cannot be corrected. Upon receipt of your Order, you will receive a notification by email sent by us.
Lebami will start processing your order and notify you on the last page that your order has been successfully received and dispatched to the delivery location you have specified. Even if you have placed a purchase for someone else, you are still liable for the cost of the Product(s) and any associated delivery fees. The Order will not be confirmed and you will be immediately taken back to the previous page on the Platforms if any payment you make is blocked or not permitted for any reason.
Allergy Warning
Products from us, such as all foods, chocolates, flowers, and other items that are offered on the platforms, might have pollen or other allergies outside those mentioned in the product descriptions on the individual product pages. When placing an order for our products, we advise clients with known allergies to proceed with caution. People who have severe allergies should not order things that could be harmful to their health. By placing an order for one or more of our products, you recognize and accept that you are aware that our products may induce an allergic reaction and that we will not be held responsible for any allergic reaction you or any third party may experience.
Product Delivery
The Product that you ordered will not be transported to any other location during any delivery of the Product by Lebami if you or the recipient have not specified an alternate address. In the context of this scenario, you agree to assume all legal obligations resulting from placing an order for Products to an incorrect address.
Loss and Damage to Property
1.Lebami does not offer any type of insurance, including cargo/delivery liability or all-risk coverage, for any goods the customer is sending or receiving (collectively, the “Item”).
2. An item’s declared value does not release Lebami from liability for any loss, damage, delay, incorrect delivery, recipient rejection of the delivery, or customer failure to supply information related to the shipment or delivery of that item.
3. The customer is responsible for any exposure to and risk of loss of any item for which the declared value exceeds the item’s actual worth.
4.Lebami retains the full, unrestricted authority to accept or deny the pickup or drop-off of any item if it is deemed to be unlawful, hazardous, or dangerous.
Username and Password
Any user log in through an email has a “password” which is determined by the user himself/herself. The “user name” is personal to the user and is unique in the sense that the same “user name” cannot be given twice to the same user or to two different users.
Lebami is not liable for any problems which may arise from the use of password.
Lebami will inform the user about the promotions, which take place in the user’s area and from which the user may benefit, by emails.
Lebami does not share the user’s information with third-party companies.
For the user to connect to the services, the user must enter his username and password. This process is called “login” to Lebami Platforms and creates an account upon checkout.
By using this Platform, you guarantee that any personal information provided by you is true, accurate, up-to-date and complete in all aspects and that you will notify us immediately of any changes to your personal information by updating your information as may be required on the Platform or by contacting us. You also agree not to impersonate any other person or entity or to use a false name or a name that you are not authorized to use.
Users’ passwords should be kept confidential at all times and must not be shared or disclosed to anyone. You agree to keep all user names, passwords, IP addresses, and computer names strictly confidential, and You are solely responsible for any liability or damages resulting from your failure to maintain confidentiality of such information. You are also solely responsible and liable for all activities originating on your account or IP address. If you believe unauthorized activity has taken place on your account, you must immediately change your password and notify Lebami of any such unauthorized activity.
Lebami denies all responsibility for any problems brought on by the use of passwords. Lebami will send the user emails informing them of local specials that may be of interest to them. Lebami never shares user information with unaffiliated companies. To access the services, the user needs to enter his login credentials. Lebami Platforms refers to this process as “login” and establishes an account after you check out. You guarantee that any personal information you provide on this platform is truthful, accurate, up to date, and complete in all respects. Additionally, you consent to promptly informing us of any modifications to your personal data through email correspondence or by changing your details on the Platform as necessary. You also agree to desist from impersonating any other person or organization, or using a false identity or one that you are not authorized to use. User passwords must always be kept confidential and never disclosed to any parties. You pledge to keep all user names, passwords, IP addresses, and computer names totally confidential. If you don’t do so, you accept full responsibility for any resulting liability or damages. Furthermore, you are fully liable and responsible for any action using your account or IP address. You should notify Lebami if you believe there has been any unauthorized activity on your account and reset your password immediately. Using the Platforms for any unlawful or unauthorized purpose is prohibited, including but not restricted to: – Disseminating any content that is unlawful, abusive, threatening, harmful, obscene, or otherwise objectionable and may result in criminal charges or civil liability, or that contravenes any other laws, regulations, or conduct codes.
– Using hacking, spoofing, or other methods to try and gain unauthorized access to the Platforms or the networks that connect to them; or damaging, stopping, or interfering with the Platforms’ ability to function.
Prohibited Activities
You are not permitted to access or use the Platforms for any purposes other than those for which Lebami provides them. The Platforms are intended for the individual users’ personal use; they cannot be used in conjunction with any business ventures unless Lebami expressly approves or endorses them. If a user engages in any unlawful activity, Lebami reserves the right to suspend, block, or cancel the user’s account and deny him access to the service. The following are only a few examples of prohibited behavior:
criminal or tortuous activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, copyright infringement, patent infringement, or theft of trade secrets; advertising to, or solicitation of, any user to buy or sell any products or services, unless authorized by Lebami; systematic retrieval of data or other content from the Platforms to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from Lebami.
Closure of account
Any activity that the Company, in its sole discretion, believes to be a violation or breach of these Terms, is against any applicable law, or is detrimental to the interests of another user, customer, recipient, subscriber, third-party Associate, content or service provider, the Company, or its Affiliates, may result in the Company terminating your access to all or part of the Service or suspending it indefinitely.
Should any portion of the Service ever become unavailable, we will not be held responsible. With or without prior warning, we retain the right to alter or terminate the Service (or any portion of it) at any time and from time to time, either permanently or temporarily.
Circumstances Outside Our Control
Any failure on our part to perform or delay in performing under these Terms due to events beyond our control or third parties would release us from liability and responsibility.
Anything that happens that is not within our reasonable control is referred to as circumstances outside our control. Examples of such things include strikes, lockouts or other industrial action by third parties, civil unrest, riots, invasions, terrorist attacks or threats of terrorist attacks, war (whether declared or not), preparations for war, preparations for a natural disaster, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster, and any closures or failures of public or private telecommunications networks or lockdowns enforced by government entities. If something beyond our control happens that prevents us from carrying out our obligations under these terms, we will do everything in our power to let you know. In the meantime, you may cancel your order for products from Lebami through the platforms, or we may cancel it on your behalf without obtaining your consent.
Permission
Lebami allows you access to the Platforms and the ability to download, email, share, and print specific pages from the Platforms for your personal, non-commercial use, as long as you follow these Terms and do not delete any trademark, copyright, or other notice that may be present. However, Lebami reserves the right to revoke this permission at any time and for any reason. Other uses are not allowed.
It is prohibited, for instance, to include the data, text, or other materials in any kind of database, compilation, archive, or cache. Except as previously mentioned, you are not permitted to change, duplicate, distribute, re-publish, transmit, display, perform, reproduce, publish, reuse, resell, license, create derivative works from, transfer, or sell any data, content, material, software, products, or services that you obtain from the Platforms. You may not access the Platforms manually, through a robot, spider, web crawler, extraction software, automated process, or device to scrape, copy, or monitor any portion of the Platforms or any information, content, or material on the Platforms, unless Lebami expressly permits you to do so. Any person or company who breaches this paragraph will be subject to Lebami’s full range of statutory and common law rights. Without prior explicit permission from Lebami, you are not permitted to link or frame any pages on the Platforms or any material, in whole or in part. You can sign up to be a “fan” of the platforms or share links to them on social networking sites by using the technologies mentioned on the platforms. All rights reserved, not otherwise given herein.
Disclaimer
The Platforms and all of the content, goods, services, information, and materials that are made available by Lebami, you, other users, or other affiliates/third parties are supplied “as is” and “as available” without any kind of guaranteed, either explicit or implicit. This include, without being limited to, links, audio files, video, text, images, and graphics submitted. To the maximum degree permitted by law, Lebami makes no promises or assurances, either explicit or implicit. Included in this are implied guarantees resulting from trade custom or performance, merchantability, fitness for a certain purpose, freedom from computer viruses, title, and noninfringement, among others.

To become a user on the Platforms of Lebami , it is required that you undertake to comply with the provisions of these Terms. By creating an account or ordering a Product using this system, you also agree to be bound by these Terms of Lebami.

If any payment made by you is not authorized or restricted for any reason, you will be automatically re-directed to the previous page on the Platforms and the Order will not be confirmed.
Our Products including but not limited to any and all Foods, Chocolates, Flowers, and and any other product available on the Platforms may contain pollen or other allergens other than those identified in the product description on the specific product pages. We urge customers with known allergies to exercise caution when ordering our products. Individuals with serious allergies should refrain from ordering products which may hazardous to their health. You hereby acknowledge and agree that you are aware that our Products may cause an allergic reaction and that under no circumstance shall we be considered liable for any allergic reaction which you or any third-party might incur following the placing of an Order of one or more of our Products.
During any Product delivery made by Lebami, if you or the recipient have not provided any alternative address for delivery, then the Product ordered by you shall not be delivered anywhere else. Within the framework of such a case, you must accept all legal responsibilities arising from ordering Products to an invalid address.

– Damaging, disabling, or impairing the operation of the Platforms or attempting to gain unauthorized access to the Platforms or to networks connected to it, through hacking, spoofing or other such similar means.
Other than personally identifiable information, which is covered under the Lebami Privacy Policy, any material you transmit or post to the Platforms will be considered non-confidential and non-proprietary. Lebami will have no obligations with respect to such material. Lebami and anyone we designate will be free to copy, disclose, distribute, incorporate and otherwise use that material and all data, images, sounds, text and other things embodied in it for any and all commercial or non-commercial purposes.
– Breaches any applicable local, national or international law.
– Is unlawful or fraudulent.
– Amounts to unauthorized advertising. or
– Contains viruses or any other harmful programs.
You may not misuse the Platforms (including by hacking).
Any comment or feedback that you submit through the Platforms must not:
– Contain any defamatory, obscene or offensive material.
– Promote violence or discrimination or anything that is considered illegal or unethical.
– Infringe the intellectual property rights of another person.
– Breach any legal duty owed to a third party (such as a duty of confidence).
– Promote illegal activity or invade another’s privacy.
– Give the impression that they originate from us. or
– Be used to impersonate another person or to misrepresent your affiliation with another person.
The above list is non-exhaustive. You will pay Lebami for all costs and damages which it incurs as a result of you breaching this clause.
Lebami will fully cooperate with any law enforcement authority or court order requesting or directing us to disclose the identity or location of anyone posting any material in breach of the above list.
You may not access or use the Platforms for any other purpose other than that for which Lebami makes it available. The Platforms are for the personal use of users only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Lebami. In case of any prohibited activities committed by the user, Lebami has the right to suspend, block or terminate the user’s account and prevent his access to log in to the service. Prohibited activities include but not limited to the following:
Displaying an advertisement, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity on or through the Platforms on behalf of that person, such as posting blogs or bulletins with a commercial purpose; deleting the copyright or other proprietary rights notice from any contribution or Lebami content; and using the Platforms in a manner inconsistent with any and all applicable laws and regulations or any other suspected malicious activities on the Lebami Platforms.
The Company may terminate your access, or suspend your access to all or part of the Service, without notice, for any reason or no reason, including conduct that the Company, in its sole discretion, believes is a violation or breach of these Terms, is in violation of any applicable law or is harmful to the interests of another user, customer, recipient, subscriber, a third-party Associate, content or service provider, the Company or its Affiliates.
We will not be liable if, for any reason, all or part of the Service is ever unavailable. We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof), with or without notice. We undertake no obligation to update, amend, or clarify information on the Service, except as required by law.
You agree that the consequences of commercial use or re-publication of content or information of Lebami may lead to serious and unlimited monetary compensation that may not be a sufficient or appropriate remedy and that Lebami will be entitled to temporary and permanent injunctive relief to prohibit such use.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by Circumstances Outside Our Control or any third-party.
Circumstances Outside Our Control means any act or event beyond our reasonable control including (without limitation) strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster, or closure or failure of public infrastructure or public or private telecommunications networks or any lockdowns imposed by Governmental bodies.
If Circumstances Outside Our Control takes place that affects the performance of our obligations under these Terms:
We will contact you as soon as reasonably possible to notify you and Our obligations under these Terms will be suspended and the time for performance of our obligations will be extended for the duration of the Circumstances Outside Our Control or You may cancel your Order for Products from Lebami through the Platforms or we may cancel it on your behalf without your prior approval.
If one or more provision(s) of these Terms is deemed unlawful, inapplicable void or for any reason unenforceable, then that provision shall be severable from these Terms and these Terms shall nevertheless remain in full force and effect to the maximum extent permitted by law.
Lebami grants you permission (which may be revoked at any time at Lebami’s sole discretion) to view the Platforms and to download, email, share via social networking or print individual pages from the Platforms in accordance with these Terms and solely for your own personal, non-commercial use, provided you do not remove any trademark, copyright or other notice contained on such pages. No other use is permitted.
You may not, for example, incorporate the information, content, or other material in any database, compilation, archive, or cache. You may not modify, copy, distribute, re-publish, transmit, display, perform, reproduce, publish, reuse, resell, license, create derivative works from, transfer, or sell any information, content, material, software, products, or services obtained from the Platforms, except as specifically noted above. Except as specifically authorized by Lebami, you may not deep-link to the Platforms for any purpose or access the Platforms manually or with any robot, spider, web crawler, extraction software, automated process or device to scrape, copy, or monitor any portion of the Platforms or any information, content, or material on the Platforms. Lebami reserves all of its statutory and common law rights against any person or entity who violates this paragraph. You may not link or frame to any pages of the Platforms or any content contained therein, whether in whole or in part, without prior written consent from Lebami. You may become a “fan” of the Platforms or share links to the Platforms via social networking technology reference on the Platforms. Any rights not expressly granted herein are reserved.
By posting contributions to any part of the Platforms, you automatically grant, and you represent and warrant that you have the right to grant, to Lebami an irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide license to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such contributions for any purpose, commercial, advertising, or otherwise, on or in connection with the Platforms or the promotion thereof, to prepare derivative works of, or incorporate into other works, such contributions, and to grant and authorize sub licenses of the foregoing.
The information, content, products, services, and materials available through the Platforms (whether provided by Lebami, you, other users or other affiliates/third parties), including without limitation, submissions, text, photos, graphics, audio files, video, and links, are provided “as is” and “as available” without warranties of any kind, either express or implied. to the maximum extent permitted by law, Lebami disclaims all representations and warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, noninfringement, freedom from computer virus, and implied warranties arising from course of dealing or course of performance.
